Terms of service

1. Agreement

By installing, accessing, or using any Android application published by Kuroki Studio ("the apps"), or by using the Kuroki Studio website at https://kurokistudio.com (the "site"), you agree to these terms. If you do not agree, do not install the apps and do not use the site.

2. Who we are

Kuroki Studio is a sole proprietorship based in Kumamoto, Japan (D-U-N-S 699200333), referred to in these terms as "Kuroki Studio", "we", or "us".

3. The apps are paid; what your purchase grants you

Each app is sold as a one-time purchase through Google Play. Your purchase grants you a personal, non-transferable, non-exclusive licence to install and use the app on any device tied to the Google account you used to buy it, for as long as the app remains compatible with that device.

You may not redistribute, resell, sublicense, decompile (except where local law overrides this restriction), or remove proprietary notices from the apps. The apps and the site are protected by copyright and other intellectual-property laws.

4. Updates

We may release updates that add features, fix bugs, or change behavior, including the removal of a feature where this is necessary for security, compliance, or technical reasons. Updates are delivered through Google Play under your normal Play Store update settings.

5. Refunds

Refunds are handled by Google Play under Google Play's standard refund policy (typically a self-service window of about 48 hours after purchase). Outside that window, contact support@kurokistudio.com and we will consider your request on a case-by-case basis. Kuroki Studio does not process payments directly and cannot issue a refund except through Google Play.

6. Acceptable use

You agree not to use the apps or the site to violate any applicable law; to infringe the rights of any other person; to attempt to interfere with the security or integrity of the apps; or to circumvent any licence or payment mechanism.

7. No warranty

The apps and the site are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the maximum extent permitted by applicable law. We do not warrant that the apps or the site will be uninterrupted, error-free, or that any defect will be corrected.

Apps such as the sound level meter, compass, level, or altimeter rely on your device's hardware sensors. They are intended for informational and recreational use only and are not certified instruments. Do not rely on them for safety-critical, regulatory, medical, navigational, or professional measurement purposes.

8. Limitation of liability

To the maximum extent permitted by applicable law, Kuroki Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of (or inability to use) the apps or the site. Kuroki Studio's total cumulative liability arising out of or relating to these terms or the apps or the site will not exceed the amount you paid for the relevant app in the twelve months preceding the event giving rise to the claim, or USD 50, whichever is greater.

Nothing in these terms limits liability that cannot be limited under applicable law (for example, liability for death or personal injury caused by negligence, or for fraud).

9. Third-party services

The apps integrate Google Play Billing and RevenueCat to process and verify your purchase. Your use of these services is also subject to their own terms and policies, summarized in the studio privacy policy.

10. Termination

You may stop using the apps at any time by uninstalling them and stop using the site at any time by not visiting it. We may suspend distribution of an app, withdraw it from Google Play, or stop publishing updates at our discretion; in that case, your licence to continue using the version you have already installed survives, subject to these terms.

11. Changes to these terms

We may update these terms from time to time. The updated version replaces this one at this URL and the effective date above is bumped. Continued use of the apps or the site after the effective date constitutes acceptance of the updated terms. The repository history at github.com/kuroki-studio/kuroki-site records every change.

12. Governing law and venue

These terms are governed by the laws of Japan, without regard to its conflict-of-laws principles. Any dispute arising under these terms will be subject to the exclusive jurisdiction of the courts of Kumamoto, Japan, save where mandatory consumer-protection law in your country of residence grants you the right to bring proceedings in your local courts.
